1. Tickets

1.1

Winter Sounds tickets are sold and issued by Ticket Solutions Pty Ltd (ACN 106 907 206) trading as Oztix as agent for Westbound Productions Pty Ltd (ACN 653 477 448) (“Winter Sounds”, “we”, “us” or “our”).

1.2

Tickets are refundable or exchangeable only in accordance with these Terms and Conditions or as otherwise required by law.

1.3

We reserve the right to cancel tickets purchased in excess of any published ticket limits.

1.4

A unique QR code is associated with each ticket issued.

1.5

Each ticket is valid only for the specific performance, date, time and venue stated on the ticket.

1.6

Ticket holders are responsible for safeguarding their ticket and associated QR code. Winter Sounds is not responsible for losses arising from unauthorised duplication or misuse of tickets.

1.7

Tickets may not be duplicated, copied or used more than once. Entry will be granted only to the first person presenting a valid ticket for scanning.

2. The Event

2.1

Winter Sounds is a multi-venue music event comprising a series of separately ticketed performances presented across various venues, including but not limited to:

• Bullarto Hall

• Glenlyon Community Hall

• St Peter’s Catholic Church, Daylesford

• The Old Schoolhouse, Kooroocheang

Winter Sounds reserves the right to add, remove or substitute venues where reasonably necessary.

2.2

Each performance is a separate event for ticketing purposes.

2.3

Winter Sounds reserves the right to vary performance times, programs, artists and venues where reasonably required by circumstances.

2.4

Winter Sounds reserves the right to vary performance times, running times and venues where reasonably required by circumstances. Where a headline artist is unable to perform and a suitable replacement cannot be provided, Winter Sounds reserves the right to cancel the affected performance and provide refunds in accordance with Clause 3.

3. Cancellation and Refunds

3.1

Each Winter Sounds performance is individually ticketed.

3.2

Cancellation, postponement or interruption of one performance does not affect any other Winter Sounds performance.

3.3

If a performance is cancelled and not rescheduled, ticket holders for that performance will be entitled to a refund of the ticket price paid.

3.4

If a performance is postponed or rescheduled, ticket holders will be offered the option of:

(a) retaining their ticket for the rescheduled performance; or
(b) receiving a refund if they are unable to attend the new date.

3.5

Refunds will apply only to the affected performance and will not extend to travel, accommodation, meals, parking or any other consequential costs incurred by patrons.

3.6

No refunds will be issued for change of mind, inability to attend, or changes in personal circumstances, except as required by law or as otherwise provided for in these Terms and Conditions.

4. Ticket Resale

4.1

Tickets may only be resold in accordance with Victorian ticket resale laws.

4.2

Tickets must not be resold for more than 10% above the original ticket price.

4.3

Winter Sounds encourages patrons wishing to resell tickets to do so through the event’s official resale partner, Tixel.

4.4

Winter Sounds accepts no responsibility for transactions conducted privately between individuals.

5. Lost, Stolen or Damaged Tickets

5.1

If you purchased tickets through Oztix and cannot locate your tickets, please contact Oztix directly via info@oztix.com.au.

6. Youth Policy

6.1

Children aged 2 years and under are admitted free of charge and do not require a ticket.

6.2

Children and young people aged 3 to 17 years inclusive must hold a valid Youth Ticket for the relevant performance.

6.3

All attendees under 18 years of age must be accompanied by a responsible parent or guardian at all times while attending Winter Sounds.

6.4

Where alcohol is available for purchase at a venue, responsible service of alcohol requirements apply and proof of age may be requested.

6.5

Any venue-specific age restrictions or conditions will be clearly communicated at the time of ticket purchase.

7. Conditions of Entry

7.1

Patrons must comply with all lawful directions issued by venue staff, Winter Sounds staff, volunteers and security personnel.

7.2

Patrons must not:

• behave in a dangerous, offensive or disruptive manner;

• bring illegal substances or dangerous items into a venue;

• enter restricted or backstage areas without authorisation;

• make professional audio or video recordings without prior written consent.

7.3

Venue operators and Winter Sounds reserve the right to refuse entry or remove any patron whose behaviour poses a risk to others or disrupts the event.

7.4

Patrons may be refused entry if intoxicated.

7.5

To minimise disruption to artists and audiences, late arrivals may be held outside the venue until a suitable break in the performance. Admission is not guaranteed once a performance has commenced.

7.6

All seating is general admission unless otherwise advised.

8. Accessibility

8.1

Winter Sounds is presented across a range of venues, including heritage buildings, churches and community halls. Accessibility features vary between venues.

8.2

Patrons requiring accessibility information or assistance are encouraged to contact Winter Sounds prior to purchasing tickets or attending a performance.

8.3

Winter Sounds will make reasonable efforts to accommodate accessibility requirements where possible.

9. Photography and Recording

9.1

Patrons acknowledge that they may be photographed, filmed or recorded while attending Winter Sounds.

9.2

Winter Sounds may use such material for promotional, archival and marketing purposes without compensation.

10. Limitation of Liability

10.1

Attendance at Winter Sounds is at the patron’s own risk.

10.2

Venues used by Winter Sounds may include heritage buildings, churches, community halls and rural properties. Patrons should take reasonable care at all times and comply with any venue-specific safety requirements.

10.3

To the maximum extent permitted by law, Westbound Productions Pty Ltd, its employees, contractors, volunteers and agents exclude liability for any loss, injury, damage or expense arising from attendance at Winter Sounds.

10.4

Nothing in these Terms and Conditions excludes any rights that cannot lawfully be excluded under the Australian Consumer Law.

11. Privacy

11.1

Ticket purchasers consent to Winter Sounds collecting and retaining personal information for ticketing, event administration and event communications.

11.2

Personal information will not be sold or disclosed to third parties except where reasonably required for event delivery or as required by law.
